These are the general terms and conditions between The Wiltshire Distilling Company Limited ("we"
or "us") and anyone who purchases a membership in The Witchmark Club ("you” or “your"). The
Wiltshire Distilling Company Limited is a private limited company registered in England and Wales
with company number 13004479.

By becoming a member you confirm to be of legal drinking age in your country. It is illegal to sell
alcohol to anyone under the legal drinking age of your country and it is an offence to attempt to buy
alcohol if you are under the legal drinking age of your country.
When you give The Wiltshire Distilling Company Limited your credit or debit card details you are
confirming that you are either the card holder, or that you have permission from the card holder to use
the card for the purpose of purchasing a membership in The Witchmark Club on
www.witchmark.co.uk.
If you choose to pay by direct debit your membership will not be confirmed until it is paid for in full. If
you fail to complete your purchase by making all the required payments the money you have paid will
be returned to you less a reasonable amount to cover our expenses in facilitating your option to pay
by direct debit and any direct costs we have encountered in fulfilling our obligations under the terms
and conditions of this document.
We may refuse to accept a payment for any reason (including if memberships are no longer available,
we cannot authorise payment, there has been a pricing or product description error). Your purchase is
accepted by us and our contract concluded when we send an email order confirmation to you. Any
products which we have not confirmed in the email will not form part of the contract.

Your purchase on our website confirms your membership of The Witchmark Club. We will have a
maximum of 600 members in The Witchmark Club. Your membership of The Witchmark Club will
start on the day you make your purchase. You can expect to receive the following products included
in your membership within 6 months of joining:

- Your first 20cl ‘taster’ bottle of new make spirit
- Two 70cl bottles of Witchmark Distillery white spirits: one gin and one vodka - all crafted from
the neutral grain spirit produced in our stills. Your bottle of botanical spirit will take longer to
produce as the spirit is aged in casks for at least six months before bottling.
- Early access before general release for special bottlings and limited edition runs.
- Invitations to select distillery events.
10% off all spirits bought in our online store or at our distillery shop – for life!
- Free distillery tours for you and a guest – at any time by prior arrangement.
- A brace of Witchmark Distillery branded Glencairn tasting glasses.
- A Witchmark Distillery branded leather notebook for whisky and gin tasting.
- A Witchmark Distillery branded polo shirt.
- You’re The Witchmark Club certificate and membership card which will be your passport to
exclusive member-only offers.

Your seven limited edition 70cl bottles of single cask whisky – released annually (starting from year
three) and drawn from the early casks of whisky produced at Witchmark Distillery will be dispatched in
the January of each year.
Your bottle of botanical spirit will be dispatched within 12 months of your membership starting.
Members names will be engraved onto The Witchmark Club plaque at the distillery once application
for memberships has closed.
Memberships are non-transferable.

All purchasers’ of The Witchmark Club membership are subject to and expressly conditioned
upon the terms and conditions for the import of alcohol in to their country.
We make no representation relative to your right to ship alcoholic beverages into your country. Laws
regarding the sale and transportation of alcoholic beverages are complex and constantly changing
which is why we would advise you to check the laws within your own country. We make no
representation to the legal rights of anyone to ship into any country and by placing your order you
accept that you are responsible for any tax/duty liabilities which may arise from receiving your
membership.
In connection with your purchase of The Witchmark Club membership, you represent that you may
purchase and receive the products ordered in compliance with all applicable laws, including, without
limitation, the alcoholic beverage control laws of the jurisdiction in which you reside, and that such
products will be used only in a lawful manner. By placing an order, you represent that you or any
recipient of any product which is purchased as a gift are 21 years of age or older. Some countries
regulations may require a business address for shipment and in those countries, you represent that
the address you have provided is a business address. Any packages that are refused or unable to be
delivered by the delivery service we use will be returned to us at your expense. We will resend to you
to the new address you provide to us. We are unable to accept the return of any product purchased
by a customer in error.

Orders will be delivered by our delivery partner of choice. Deliveries must be signed for by an adult
and ID may be required under the challenge 25 policy if this is in force in your country.
If all attempts to deliver the goods fail then the goods will be returned to us. We will issue a refund
less the costs of the delivery and return.
If there is a problem with your order you must inform us within 21 days of receipt of your order. We will
accept no liability for orders unchecked outside of this period.
If a defect is identified with respect to any products supplied by us, we will replace the defective
product or reimburse the anticipated purchase price in our sole discretion, upon the return of such
product in accordance with our instructions.

WE SHALL IN ANY EVENT NIOT BE LIABLE FOR
INCIDENTAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY, PUNITIVE OR SPECIAL DAMAGES OF
ANY KIND RESULTING FROM ANY USE OR FAILURE OF THE PRODUCTS, WHETHER ARISING
IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL
THEORY, EXCEPT AS PROVIDED BY APPLICABLE LAW. THIS WARRANTY IS EXCLUSIVE AND
WE MAKE NO OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED
WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE.

The personal data collected by us from you, may be used by us to: (i) manage the delivery of goods
to you, (ii) pass information about you to our agents, advisors and employees to carry out services for
us, (iii) notify you about enhancements to our services such as: functionality changes to the website,
new services and special features, and offers or competitions we think you will find interesting, (iv)
market our products and services and those of any third parties and (v) contact you by mail,
telephone, email, text message, or any other reasonable method. We will not pass on or sell your
details to any third parties for marketing purposes.
These terms and conditions shall be governed by English law and we both agree to the non-exclusive
jurisdiction of the English courts.
